- Know all men by these presents that I Alonzo Stevens of Essex in the County of Chittenden am held and firmly bound unto Alfred Sawyer of Westford in said County in the sum of Two Thousand dollars to be paid to the said Alfred Sawyer or his executors administrators or assigns for which payment will and truly to be made I bind myself my heirs Executors and administrators firmly by theses presents, Signed with my hand and sealed with my seal & dated this 1st day of September AD 1853.
The conditions of the above obligations are such that whereas Lucy Ann Sawyer the wife of the said Alfred Sawyer has clandestinely left the said Alfred Sawyer and taken with her Mary Eola Sawyer and Olivia Sawyer the two youngest children of the said Alfred & Lucy Ann, and refuses to cohabit and live with him, and whereas the said Alfred has divided with the said Lucy Ann his Estate & property nul & personal and has divided and conveyed for the benefit and future support of the said Lucy Ann and their two children aforesaid an equitable portion of his estate & property. And whereas it is agreed & understood that the property so conveyed is to be in full satisfaction & discharge of all claims of the said Lucy Ann (struck) and the children of aforesaid (struck) for future maintenance and support of the said Lucy Ann and the children aforesaid and of all claims which the said Lucy Ann has or may thereafter have to Alimony, dower or a homestead against the said Alfred or to or against his Estate or property.
Now if the said Lucy Ann shall hereafter support & maintain herself, the two children aforesaid without any assistance from the said Alfred and without charge to him or his Estate and property, & shall not hereafter claim any right to alimony, dower or homestead against the said Alfred his Estate & property. And if the said Alonzo Stevens shall indemnify & save harmful the said Alfred from all assuages & costs and charges which he may sustain in the future support & maintenance of the said Lucy Ann and the two children aforesaid & shall at all times hereafter indemnify & save hereafter the said Alfred his heir Executors administrators & assigns against all future maintenance & support of the said Lucy Ann their children aforesaid & against all claims & assuages of the claim Lucy Ann for alimony dower or a homestead out of the Estate or property of the said Alfred which he now owns or may hereafter acquire or possess, or which may herein after come to his personal representation after his decease then this obligation to be said otherwise to be & remain in full force & effect
